When you buy a Biolytix BioPod, you automatically receive our standard BioPod Warranty (detailed below).
For long term peace of mind we recommend that you extend this warranty by taking advantage of the Premium Care Agreement.
Biolytix BioPod Warranty
Biolytix Water Australia Pty Ltd (ACN 097 798 966) (“Biolytix”) warrants the Biolytix® BioPod system will be free from defects in material and workmanship for the following periods of time, commencing on the date of completion of the installation, in accordance with the conditions set out below.
Vessel: 15 years
Filter Media: 1 year
Pump & Electrics: 1 year
Construction & Workmanship: 1 year
Irrigation Components: 1 year
1. Biolytix will, during the warranty period, repair or replace (at its option) the equipment or such
parts as are proven to be faulty in manufacture or installation, with the same or equivalent
product for no charge.
2. This warranty is valid only in relation to the performance of the Biolytix BioPod system to treat
waste water inflow from a source connected to the system by Biolytix or a Biolytix Accredited
Installation Partner into secondary effluent as per Australian Standard AS1546.3.
3. This warranty does not cover defects due to:
(a) the connection or otherwise of any additional sources of waste into the system either directly
or indirectly, other than as installed by Biolytix or a Biolytix Accredited Installation Partner or in
accordance with Biolytix’ written instructions and documentation;
(b) modifications of the surrounding landscape after installation of the Biolytix BioPod system
without consultation with Biolytix or a Biolytix Accredited Installation Partner;
(c) failure to use the system in accordance with the Owner’s Manual or other instructions from
Biolytix or a Biolytix Accredited Installation Partner;
(d) a Force Majeure Event, where a Force Majeure Event means any cause outside the reasonable
control of Biolytix, including but not limited to, damage resulting from earthquake, fire, flood,
storm, lightning, soil subsidence, ground water table variations, electrical supply fault or
plumbing fault;
(e) the system being required to bear loads (either hydraulic or biological) greater than that for
which it was supplied;
(f) the actions of a third party;
(g) any modifications or repairs being undertaken to the system by anyone other than Biolytix or
a Biolytix Accredited Installation Partner;
4. All charges incurred for labour, repairs, replacement parts, due to defects arising from any of
the causes listed in paragraph 3 shall be the responsibility of the owner.
5. This warranty is conditional upon the full invoiced price being received for supply and delivery
of the System and upon the owner notifying Biolytix or a Biolytix Accredited Installation Partner
immediately upon becoming aware of any defects. Proof of purchase (including relevant
installation documentation) must be supplied with any warranty claim. All warranty claims must
be made within 7 days of the end of the warranty period.
6. To the fullest extent permitted by law, Biolytix will not be liable to the customer or owner for
any incidental or consequential loss.
7. The rights described in this warranty certificate are in addition to the statutory rights to which
you may be entitled under the Trade Practices Act 1974 and other applicable Australian
consumer protection laws and regulations.
